Hi there, Quick question for you those whn went through this problems. I am a US citizen and now I am applying for my wife who use to be students tara ahile out of status for nearly 2ys. Do you think is there any problem on her applications? What could be the best way? Do you guys reccomend her to go back Nepal and process from there?? Thanks hoping to hear from you !!

Just go marry her and follow all the process.
Once you marry her , her status will be adjusted.And she will be on status as a married person to USC.
I don;t see no problems unless the marriage is genuine.
Also you can process the application from nepal.
Either ways its the same thing but the first one is better since you guys can get it done in 3 months.

But then this is not the professional advice. Better go see the immi. lawyer.

it is best to see an immigration lawyer spending some money for complicated issue like this.

Thanks guys ! for all the support and info ! Appreciated ! Surely, I will go and see the attonery. FYI,we been legally married for more than 3yrs now and the marriage been registered here in US since the day first. Thanks again !!

 I know I am digging this out of the grave but how did she get here? If she came here on some sort of a visa, then you dont have to complicate things with a lawyer.  The fact that you guys have been married for over 3 years is big plus, unless she was involved in crime and got convicted with a misdemeanor or worse.

Thanks for your concerned !! And please dont even think about your are digging, actually it helps !! Answering your questions. She came to this country as a student and complited here degree few years back ! And could not keep up the student status as we all know how expensive it is to pay the school here in MA.! And we decided to stay out of status. Besides the status issues there is not any law ful issues!! Do you still think that she should go back home to Nepal and process from there?? Or what could be the best idea?? Thanks hoping to hear from you guys soon !!

I don't think she should go to Nepal her 3 year to 10 year ban may trigger since she has stayed here unlawfully. I would think it is better to do aos from here. Why haven't u done anything yet. Since she was a student she entered the country with inspection so I don't think u will have any major prob. But file her petition asap so her status changes to a green card appliciant rather than an unlawful alien.

I agree with Kalopani.Drop the idea of processing from Nepal coz she has already broken the rules .Hire a lawyer and do it from here.

Just file forms I-130 and form I-485 together with the Chicago Lockbox.  It should be done in less than 4 months. No need of anyone's advise. Just use USCIS website.  If you are USC, the process is simple and easy.  Once you leave the country, the process will take much longer since your I-130 after approval, will be routed to NVC and then to the consulate.  It would be stupid to apply from abroad. NVC's officers are laziest on earth; worse than Nepal.

Those USCIS fees are killing me. What would you say, if I do this on my own?  Some one here suggest me to file forms I-130 and form I-485 together with the Chicago Lockbox. Should I file form I-130 first and wait for the approval ?? Or send both in the very beginning?? 

My biggest concerned is we failed to keep the student status after the graduation, which is more than 3rys now !! And I just got my  USC.
