 Confusion: Green card through TPS or Green card through H1 and work permit through TPS?

Hi Everyone,

I recently got a job as a junior developer. I am on OPT and my OPT will expire in 3 months (Oct, 2019). I am planning on applying for work permit through TPS. How early should I apply to get it on time before my OPT expires. I am maintaining my f1 status and I want to keep doing that. I don't want TPS work permit to cancel my OPT work permit if I apply it way before my OPT expires (I know it usually takes 90 days) because I want to join school/class in 5 months (in March 2019) as we are allowed to do that. I need time to learn for my new job.

My another concern is can I apply a green card through TPS or is it a better idea to apply for a green card after getting selected for h1?

Please guys let me know what do you think and any suggestions, any experience

Apply ASAP. In the mean time get your application process for school. Remember 60 days after opt expiration is when your Sevis/f1 terminates. Get a i20 before that.
You can continue working with TPS was until March 2020. Or until the expiration. F1 will need to be maintained at the same time if you want to be in status.
GC application can be processed anytime provided that you have a company who will do it. No need to wait on h1b. That takes 1-2 years currently, during that period you have to somehow maintain legal status.

@maxpayne, thank you for very helpful information. I was worried if I apply for TPS work permit right now and if it gets approved within a month then my OPT expires sooner because I heard we can't have two work permits? And I will end up having a lesser time and I have to join classes sooner? I also have that envelope to expedite, the work permit request through TPS (I am not sure if there is any other name for that, I saw someone posting about it long time ago for faster processing). Please let me know if you have any idea about it.

I also need to know if I can have 2 i20s from different schools. Do I have to let my school know that I am using TPS work permit and working? My DSO people get confused about this working situation using TPS.

We don't have to renew TPS right f we did the last time It got extended? My SEVP Portal expired, it's asking me to call DSO, I hope I am fine

Please also let me know any college, easy to get admission and don't have attend every week. I don't want to go those "risky" colleges, where people don't have do assignments and get good grades.

Sathi ho please let me know, I need you help.

Youre complicating things for yourself. You need to align to School's admission schedules rather than you OPT. Find the college requirements first. Admission process itself takes months and deadlines usually are more than a month out.
Your priority should be to get a I20 and transfer your SEVIS for Fall 2019 or Spring 2020. Once you have a signed i20, you still get 90 days to actually start the program. March 2019 may be a bit of a stretch because your 60 initial+90 days start date will expire. 90 day clock starts when you get your new i20 signed.
For TPS EAD concerns, you can just apply for TPS reinstatement first without EAD. Wait for approval then apply EAD later.

@maxpayne

I applied the last time TPS was extended. It shows valid from 06/25/2018 to 06/24/2019 and now it got automatically extended, do I have to apply again for TPS? I thought I can directly apply for EAD through TPS?

Please let me know if I am missing any information.

Ignore the TPS application part then. Follow the rest. Prep TPS ead application. Send it end of July.

My Doti consultancy is not sure about filing a green card because this is my first project and it's tps. Will it be eb2 or some other category in my case? What should I do? does it matter if i have experience or not to apply for a green card through TPS? I think the requirement is i have to be on a project throughout the process or before applying for a green card, to be sponsored. I was planning to apply after a month of my first project because I wanted to see if I could survive on the project.

Guys please tell me what is the criteria to apply for a green card through TPS to be sponsored for someone who is going to work on the first project.
